Using Gnammus mindfully

Last updated: 21 October 2026

Preamble

These Terms and Conditions ("Terms") govern the use of the Gnammus platform and any legal relationship between the User and RTLP S.r.l. ("RTLP").

The User is requested to read this document carefully before using the Platform.

Gnammus is a service of:

RTLP S.r.l. — Corte dei Mesagnesi 30 — 73100 Lecce (LE) — Italia

VAT number and tax code: 02683850743 — REA: LE-361688

Email address: [email protected] — Certified email (PEC): [email protected]

Certain provisions of these Terms may apply only to certain categories of Users. In particular, certain provisions may apply only to Consumers or only to Users who do not act as Consumers. Such limitations are always explicitly mentioned in the relevant clause. Where no such mention is made, the clauses apply to all Users.

Art. 1 — Definitions

In addition to the terms defined in the body of these Terms, the following definitions apply. Terms defined in these Terms, when capitalised, have the same meaning whether used in the singular or the plural.

a. Platform (or "Gnammus"): the Gnammus social networking platform, accessible via the web and a mobile application, which enables the provision of the Service.

b. Service: the service offered through the Platform as described in these Terms and on the Platform itself.

c. User: any natural or legal person who uses the Platform.

d. Consumer: any User who qualifies as a consumer under applicable law.

e. Agreement: any legally binding or contractual relationship between RTLP and the User governed by these Terms.

f. European (or "Europe"): applies where the User, irrespective of nationality, is located in the European Union.

Art. 2 — Conditions of use

2.1. Unless otherwise specified, the conditions of use of the Platform set out in these Terms apply generally.

2.2. Further conditions of use or access applicable in particular situations are expressly indicated in these Terms or in documents linked to them (hereinafter the "Appendices"). In the event of conflict between these Terms and the Appendices, the provisions of the Appendices prevail, solely with regard to the subject matter they govern.

2.3. By using the Platform, the User declares that they have read, understood and accepted these Terms in full.

2.4. Entire agreement. These Terms and the Appendices constitute the entire agreement between the User and RTLP with regard to the subject matter governed and supersede any prior communication, understanding or agreement between the parties concerning the same subject matter. The foregoing is without prejudice to the rights granted by applicable law to a User acting as a Consumer, or to pre-contractual statements made by RTLP which the law requires to be regarded as forming part of the contract.

Art. 3 — Access requirements, registration and account

3.1. Minimum age. Access to the Platform and the creation of an account are restricted to Users who have reached the age of 14. Where the law of the country in which the User resides lays down a higher minimum age for access to information society services or for the validity of consent to the processing of personal data, that higher age applies. The applicable minimum age is determined on the basis of the date of birth and country of residence declared by the User at registration, and the Platform does not allow a User who does not meet this requirement to create an account. The thresholds applied by RTLP reflect the legislation in force in each country and are subject to updating where that legislation changes.

3.2. Minor Users. A User who has not reached the age of 18 declares that they have obtained the consent of a parent or of the person holding parental responsibility over them. That person accepts these Terms in the name and on behalf of the minor and is liable for the minor's use of the Platform. A User who has not reached the age of 18 may not carry out promotional activity on the Platform for the benefit of third parties, within the meaning of Art. 11.5 of the Moderation Policy, without the authorisation of that same person; such authorisation must be specific to the promotional activity and is additional to the consent referred to in the first sentence, which does not include it. RTLP may require the User to declare that they hold such authorisation when indicating the commercial nature of the content.

3.3. Age-restricted content. Access to content concerning alcoholic beverages as such is restricted to Users who have reached the higher of the age of 18 and the minimum age laid down by the law of their country of residence, as provided for in Art. 10.6 of the Gnammus Moderation Policy; access to the other categories of age-restricted content is restricted to Users who have reached the age of 18. The restriction does not apply to content in which an alcoholic beverage features as an ingredient of a food preparation. A User who has not reached the required age may publish content subject to the restriction and retains access to the content they have published themselves, as provided for in Arts. 10.7 and 10.8 of that Policy. A User who has not reached the age of 18 is, however, prohibited from publishing content intended to promote alcoholic beverages for the benefit of third parties, as provided for in that same Art. 10.8.

3.4. Subsequent verification of the age requirement. Where it emerges, or there are reasonable grounds to believe, that a User has not reached the minimum age required under Art. 3.1, RTLP suspends the account as a precautionary measure and requests the User to provide evidence capable of demonstrating that the age requirement is met, granting the User a period of 14 days to respond. The account remains suspended for the entire duration of that period and until the verification has been completed. If no response is received within that period or the verification has a negative outcome, RTLP deletes the account and the data associated with it, as provided for in the Gnammus Privacy Policy. RTLP may, at its discretion, grant the User a longer period where the circumstances so justify.

3.5. In order to access certain features of the Platform, the User must create an account by providing truthful, complete and up-to-date information.

3.6. The User is responsible for keeping their login credentials (username and password) confidential and for all activities carried out through their account. In the event of unauthorised access or any security breach, the User must promptly inform RTLP.

3.7. The User undertakes to:

  • provide truthful and up-to-date data at registration and keep such data up to date;
  • correctly declare their date of birth and country of residence, keep them up to date and not circumvent, including by means of subsequent changes, the access restrictions laid down in the preceding paragraphs;
  • not create accounts with false or misleading identities;
  • not assign or transfer their account to third parties without RTLP's written consent.

3.8. RTLP reserves the right to suspend or delete accounts that breach these Terms, that have been inactive for an extended period or that were created using false information. Measures taken in respect of the account are communicated to the User together with a statement of reasons and are subject to review as provided for in Arts. 13 and 14 of the Moderation Policy.

3.9. The User may request the deletion of their account at any time by following the procedures indicated on the Platform. Deletion entails the loss of access to the content and data associated with the account, without prejudice to the User's rights under data protection legislation.

Art. 4 — Platform content

4.1. Unless otherwise specified or clearly recognisable, all content available on the Platform is owned by RTLP or its licensors.

4.2. RTLP takes the utmost care to ensure that the content available on the Platform does not infringe applicable law or third-party rights. However, it is not always possible to guarantee this result. In such cases, without prejudice to any rights that may be exercised at law, Users are requested to address any related complaints to the contact details indicated in these Terms or through the reporting tools available on the Platform.

4.3. RTLP holds and expressly reserves all intellectual property rights in the content of the Platform.

4.4. Users are not authorised to use the content in any way that is not necessary for or implicit in the proper use of the Service. In particular, but without limitation, Users are prohibited from copying, downloading, sharing beyond the specified limits, modifying, translating, adapting, publishing, transmitting, selling, sublicensing, transforming, transferring to third parties or creating derivative works from the content available on the Platform, or from allowing third parties to undertake such activities through their account or device, even without their knowledge. The prohibition includes the use of the content for the purposes prohibited by Art. 7.3.

4.5. Where expressly indicated on the Platform, the User is authorised to download, copy or share certain content exclusively for personal and non-commercial purposes, provided that the attribution of authorship of the work and any other indication required by RTLP are respected. The exceptions set out in Arts. 7.5 and 7.6 remain unaffected.

4.6. The limitations and exceptions provided for by copyright law remain unaffected.

Art. 5 — User-generated content

5.1. The Platform allows Users to create, upload, publish and share content (texts, images, videos, reviews and other materials, hereinafter "User Content").

5.2. The User retains ownership of the authorship rights in their User Content. By publishing User Content on the Platform, the User grants RTLP a non-exclusive, royalty-free, transferable, sublicensable, worldwide licence to use, reproduce, modify, adapt, translate, distribute and display such content in connection with the operation and promotion of the Platform and the Service. This licence terminates upon the removal of the User Content from the Platform, save in respect of content already shared by other Users or incorporated into features of the Platform prior to removal.

5.3. The User represents and warrants that:

  • the User Content does not infringe intellectual property rights, privacy rights or other rights of third parties;
  • the User Content complies with applicable law and with the Gnammus Moderation Policy;
  • the User holds all the rights and authorisations necessary to publish the User Content and to grant the licence referred to in paragraph 5.2;
  • where the User Content is intended to promote a third party in return for payment or any other benefit, the User has indicated its commercial nature by means of the dedicated feature, as provided for in Art. 11.5 of the Moderation Policy.

5.4. The User is solely responsible for their User Content. RTLP is under no obligation to check User Content in advance, but reserves the right to refuse to publish, or to remove, modify or restrict the visibility of, any content that breaches these Terms, the Moderation Policy or applicable law. Measures taken are communicated to the User together with a statement of reasons and are subject to review as provided for in Arts. 13 and 14 of the Moderation Policy.

5.5. RTLP is not liable for User Content published by Users on the Platform. RTLP does not verify or guarantee the accuracy, safety, suitability or correctness of User Content, including recipes, dietary suggestions or instructions relating to the preparation of food and beverages.

5.6. Outputs generated by RTLP. The User retains the rights referred to in Art. 5.2 in their User Content in the form in which the User uploaded it. The outputs generated by RTLP — such as translations, adaptations, system metadata, ranking signals and similar outputs — remain the property of RTLP and are not available to the User for any purpose other than their enjoyment on the Platform, unless otherwise authorised in writing by RTLP.

Art. 6 — Access to external resources

6.1. Through the Platform, Users may have access to resources provided by third parties. Users acknowledge and accept that RTLP has no control over such resources and is therefore not responsible for their content or availability.

6.2. The conditions applicable to resources provided by third parties, including those relating to any grant of rights in content, are determined by those third parties and governed by their respective terms and conditions or, in the absence thereof, by law.

Art. 7 — Permitted use

7.1. The Platform and the Service may be used only for the purposes for which they are offered, in accordance with these Terms and applicable law. Access and use take place exclusively through the official interfaces made available by RTLP — website and mobile applications — save where RTLP has given written authorisation or where the public application programming interfaces documented by RTLP are used, under the conditions specified therein.

7.2. It is the sole responsibility of the User to ensure that their use of the Platform and the Service does not infringe the law, regulations or the rights of third parties.

7.3. Prohibitions. Subject to Arts. 7.5 and 7.6, it is in particular prohibited to:

  • access the Platform or the Service, interact with them or publish content by means of bots, scripts, crawlers, automated tools or any means other than the interfaces referred to in Art. 7.1;
  • extract, bulk download, index or reconstruct datasets from the content, metadata, profiles, relationships between Users, feeds or search results of the Platform;
  • use content or data of the Platform, including the outputs referred to in Art. 5.6, to train, fine-tune, evaluate or improve artificial intelligence, machine learning or machine translation models or similar systems;
  • send or generate content, messages, reports or other requests in bulk, repeatedly or artificially, so as to degrade the Service or circumvent technical limits;
  • circumvent or attempt to circumvent technical protection measures, rate limits, or authentication or access control mechanisms.

7.4. RTLP reserves the right to take any appropriate measure to protect its legitimate interests, and in particular to deny the User access to the Platform or the Service, terminate contracts and report any objectionable activity carried out through the Platform or the Service to the competent authorities, whenever the User engages in, or is suspected of engaging in:

  • breaches of laws, regulations or these Terms;
  • infringements of third-party rights;
  • acts that may considerably prejudice the legitimate interests of RTLP;
  • offensive conduct towards RTLP or third parties.

7.5. Previews for search engines and sharing. Search engines and preview services are permitted to access only the preview versions that RTLP makes available without authentication for indexing and for preview protocols — such as Open Graph — within the limits of those versions and of the technical instructions published by RTLP.

7.6. Academic research. Use of the Platform for academic research purposes intended for publication is permitted provided that it does not involve the conduct prohibited by Art. 7.3. Researchers are invited to cite the Platform as a source and, where access or methods beyond the public interfaces are required, to contact RTLP at the contact details set out in Art. 16.

Art. 8 — Resale of the Service

8.1. Users are not authorised to reproduce, duplicate, copy, sell, resell or exploit the Platform or the Service, in whole or in part, without RTLP's prior written consent, given either directly or through a legitimate resale programme.

Art. 9 — Limitation of liability

9.1. Scope. RTLP's liability is governed by applicable law. The limitations provided for in Arts. 9.3 and 9.4 operate within the limits laid down in Art. 9.2.

9.2. Unlimited liability. Nothing in these Terms excludes or limits RTLP's liability:

  • for damage caused by wilful misconduct or gross negligence;
  • for death or personal injury, including damage to a person's physical or mental integrity;
  • for the infringement of fundamental rights of the person;
  • for breach of the essential obligations of the Agreement, namely the obligations strictly necessary to achieve the essential purpose of the contract;
  • for infringement of data protection legislation, pursuant to Art. 82 of Regulation (EU) 2016/679;
  • towards a User acting as a Consumer, to the extent provided for by the mandatory rules for their protection, including those concerning the conformity of digital content and digital services.

9.3. Excluded damage. RTLP is not liable for indirect or unforeseeable damage, loss of profit, loss of data, loss of business opportunities, or damage resulting from temporary interruptions or malfunctions of the Platform, including the interruptions referred to in Art. 11.

9.4. Maximum limit. Under no circumstances shall RTLP's aggregate liability exceed:

  • for a User who has purchased paid services, the amount paid by that User to RTLP during the 12 months preceding the event giving rise to the liability or during the term of the Agreement, if shorter;
  • for a User who uses only the free services, the amount of EUR 60.

9.5. Beneficiaries and basis. The exclusions and limitations in this article also apply for the benefit of RTLP's employees and contractors, irrespective of whether the liability is contractual or non-contractual.

Art. 10 — Indemnity

10.1. The User shall indemnify and hold harmless RTLP, its employees and contractors against any claim brought by third parties, including costs and legal fees, arising:

  • from content published or transmitted by the User, or from the User's conduct, including through the User's employees or agents, in breach of the law, these Terms or the Appendices;
  • from the User's infringement of third-party rights, including rights relating to the protection of personal data and to intellectual property;
  • from fraudulent or malicious conduct by the User, including the exploitation of malfunctions or vulnerabilities of the Platform;
  • from the use of the account by third parties to whom the User has disclosed their credentials, or who have obtained them as a result of the User's failure to keep them safe.

10.2. The indemnity does not apply to damage attributable to RTLP, including damage resulting from malfunctions, loss of data or access to the account made possible by vulnerabilities in RTLP's systems.

Art. 11 — Interruption of the Service

11.1. In order to ensure the best possible level of service, RTLP reserves the right to interrupt the Service for maintenance purposes, system updates or any other change, giving appropriate notice to Users.

11.2. To the extent permitted by law, RTLP reserves the right to suspend or completely discontinue the Service. In the event of discontinuation, RTLP will endeavour to enable Users to extract their personal data and information, in compliance with Users' rights relating to continued use of the product or to compensation, in accordance with the law.

11.3. The Service may be unavailable for reasons beyond RTLP's reasonable control, such as force majeure events (for example infrastructure failures, power outages, etc.).

Art. 12 — Privacy

12.1. Information on the processing of personal data is contained in the Gnammus Privacy Policy, available on the Platform. The User is invited to consult the Privacy Policy for any information concerning the collection, processing and protection of their personal data. Information on cookies and tracking technologies is contained in the Gnammus Cookie Policy.

Art. 13 — Intellectual property

13.1. Without prejudice to any more specific provision contained in these Terms, intellectual and industrial property rights, such as copyright, trade marks, patents and designs relating to the Platform, are held exclusively by RTLP or its licensors and are protected under the laws and international treaties applicable to intellectual property.

13.2. All trade marks — whether word or figurative — and all other distinctive signs, trade names, service marks, illustrations, images or logos appearing in connection with the Platform are and remain the exclusive property of RTLP or its licensors and are protected under the applicable laws and international treaties.

Art. 14 — Amendments to the Terms

14.1. Grounds. RTLP may amend these Terms for the following reasons: adaptation to changes in legislation or to decisions of authorities; introduction, modification or discontinuation of services or features; requirements relating to the security and integrity of the Service; technical development of the Platform; clarification or correction of the text. RTLP notifies Users of the amendments with reasonable notice.

14.2. Amendments shall take effect in the relationship with the User only from the time notified to the User.

14.3. Acceptance. Amendments that restrict the User's rights or extend the User's obligations are subject to the User's express acceptance, which is requested upon the first access to the Platform following their entry into force. Other amendments, including those required by law, are deemed accepted through use of the Service following notification. A User who does not accept the amendments may terminate the Agreement by deleting their account.

14.4. The previous version of the Terms continues to govern the relationship until the User accepts the amendments. That version may be requested from RTLP.

14.5. Where required by law, RTLP will notify Users in advance of the date on which the amended Terms enter into force.

Art. 15 — Assignment of the contract

15.1. RTLP reserves the right to transfer, assign, dispose of, novate or subcontract any or all of its rights and obligations under these Terms, having regard to the legitimate interests of Users. The provisions on amendments to these Terms apply.

15.2. The User is not authorised to assign or transfer their rights and obligations under these Terms without RTLP's written consent.

Art. 16 — Communications, contact details and points of contact

16.1. All communications relating to the use of the Platform must be sent to the contact details indicated in these Terms.

16.2. Point of contact for Users. Pursuant to Art. 12 of Regulation (EU) 2022/2065, RTLP designates the email address [email protected] as its single point of contact enabling Users to communicate directly and rapidly with it. Alternatively, the User may use the reporting and support tools available within the Platform, the certified email (PEC) address [email protected] or the postal address indicated at the beginning of these Terms. Communications received are not handled solely by automated tools: each of them is guaranteed to be examined by RTLP staff.

16.3. Point of contact for authorities. Pursuant to Art. 11 of Regulation (EU) 2022/2065, RTLP designates the certified email (PEC) address [email protected], and, alternatively, the email address [email protected], as its single point of contact for communications with the authorities of the Member States, the European Commission and the European Board for Digital Services.

16.4. Languages. Communications addressed to the points of contact referred to in Arts. 16.2 and 16.3 may be made in Italian or in English.

16.5. Reporting content. The procedures for notifying RTLP of content considered illegal or non-compliant, and the procedure for handling notices, are governed by Art. 12 of the Gnammus Moderation Policy.

Art. 17 — No implied waiver

17.1. RTLP's failure to exercise statutory rights or claims arising under these Terms does not constitute a waiver thereof. No waiver shall be deemed a further or continuing waiver of a specific right or of any other right.

Art. 18 — Severability

18.1. Should any provision of these Terms be or become void or ineffective under applicable law, the nullity or ineffectiveness of that provision shall not affect the remaining provisions, which shall therefore remain valid and effective.

18.2. For Users in the United States: any invalid or unenforceable provision shall be interpreted and reformed to the extent necessary to render it valid, enforceable and consistent with its original intent. These Terms shall be enforced to the fullest extent permitted by law. Art. 2.4 on the entire agreement remains unaffected.

18.3. For Users in Europe: should a provision of these Terms be or become void, invalid or ineffective, the parties shall endeavour to agree amicably on a valid and effective replacement provision. Failing agreement, where permitted or provided for by applicable law, the void, invalid or ineffective provision shall be replaced by the applicable statutory rules. Notwithstanding the foregoing, the nullity, invalidity or ineffectiveness of a specific provision of these Terms shall not entail the nullity of the entire Agreement, unless the void, invalid or ineffective provisions are essential or of such importance that the parties would not have concluded the contract had they known that the provision would be invalid, or where the remaining provisions would impose an excessive and unacceptable burden on either party.

Art. 19 — Governing law and jurisdiction

19.1. These Terms are governed by Italian law, irrespective of conflict-of-laws rules.

19.2. Without prejudice to Arts. 19.3 and 19.4 below and to Art. 20.2, the courts of the place where RTLP is established (Lecce, Italy) shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

19.3. Precedence of local mandatory rules. The choice of law under Art. 19.1 and the choice of court under Art. 19.2 apply to the extent permitted by the law of the country of the User's habitual residence. Where that law contains mandatory rules — in particular for the protection of consumers — that exclude, limit or render ineffective the choice made in these Terms, those mandatory rules prevail, solely to the extent of what they provide. The remaining provisions of these Terms remain valid and effective.

19.4. Manner of application. For Users resident in the European Union, the precedence referred to in Art. 19.3 applies automatically, without the User having to demonstrate anything. For Users resident in other countries, the burden of proving the applicability of a law other than Italian law and that the conditions for its application are met lies with the User invoking it.

Art. 20 — Jurisdiction-specific provisions

The following provisions apply in addition to, or by way of derogation from, these Terms, solely in respect of Users in the jurisdictions indicated.

20.1. Users in the United States

a. Disclaimer of warranties. RTLP provides the Platform on an "as is" and "as available" basis. Use of the Service is at the User's sole risk. To the fullest extent permitted by law, RTLP expressly disclaims all conditions, terms and warranties of any kind — whether express, implied, statutory or otherwise, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose or non-infringement of third-party rights. No advice or information, whether oral or written, obtained by the User from RTLP or through the Service shall create any warranty not expressly stated herein.

Without limiting the foregoing, RTLP and its subsidiaries, affiliates, officers, agents, partners, suppliers and employees do not warrant that the content is accurate, reliable or correct; that the Service will be available on an uninterrupted and secure basis at any particular time or location; that any defects or errors will be corrected; or that the Service is free of viruses or other harmful components. Any content downloaded or otherwise obtained through the use of the Service is downloaded at the User's own risk, and the User is solely responsible for any damage to their computer system or mobile device or for any loss of data resulting from such download or from the use of the Service.

RTLP does not warrant, endorse, guarantee or assume responsibility for any product or service advertised or offered by third parties through the Service, or for any hyperlinked website or service. RTLP is not a party to, and does not monitor, any transaction between Users and third-party providers of products or services.

The Service may become inaccessible or may not function properly with the User's browser, device or operating system. RTLP shall not be liable for any damage, whether perceived or actual, arising from the content, operation or use of the Service.

Federal law, some states and other jurisdictions do not allow the exclusion and limitation of certain implied warranties. The above exclusions may not apply to Users. The Agreement gives Users specific legal rights. Users may also have other rights, which vary from state to state. The limitations and exclusions under the Agreement apply to the extent permitted by law.

b. Limitation of liability. To the fullest extent permitted by applicable law, in no event shall RTLP and its subsidiaries, affiliates, officers, agents, partners, suppliers and employees be liable for:

  • any indirect, incidental, special, consequential or exemplary damages, including damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the Service;
  • any damage, loss or injury resulting from hacking, tampering or other unauthorised access to or use of the Service or the User's account or the information contained therein;
  • any errors, mistakes or inaccuracies of content;
  • personal injury or property damage, of any nature whatsoever, resulting from the User's access to or use of the Service;
  • any unauthorised access to RTLP's servers or to any personal information stored therein;
  • any interruption or cessation of transmission to or from the Service;
  • any bugs, viruses, trojan horses or the like that may be transmitted to or through the Service;
  • any errors or omissions in any content or any loss or damage incurred as a result of the use of any content posted, sent, transmitted or otherwise made available through the Service;
  • the defamatory, offensive or illegal conduct of any User or third party.

This limitation of liability section applies to the fullest extent permitted by law in the applicable jurisdiction, whether the alleged liability is based on contract, tort, negligence, strict liability or any other basis, even if the User has been advised of the possibility of such damage.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to the User. These Terms give the User specific legal rights, and the User may also have other rights, which vary from jurisdiction to jurisdiction. The disclaimers, exclusions or limitations of liability set out in these Terms shall not apply beyond the limits permitted by applicable law.

20.2. Consumers in Europe and equivalent jurisdictions

a. Jurisdiction. The provisions on jurisdiction in Art. 19.2 do not apply to Users acting as Consumers who are resident in the European Union or in a country party to the 2007 Lugano Convention (Switzerland, Norway and Iceland).

b. Consumers in other countries. For Users acting as Consumers who are resident in countries other than those referred to in letter a, Arts. 19.3 and 19.4 apply.

c. Out-of-court dispute resolution. RTLP invites a User acting as a Consumer to contact it first at the contact details set out in Art. 16, with a view to settling any dispute amicably. If the dispute is not resolved, a Consumer resident in Italy may initiate an out-of-court dispute resolution procedure before the ADR entities entered in the list kept by the Italian Ministry of Enterprises and Made in Italy (Ministero delle imprese e del made in Italy) pursuant to Arts. 141-bis et seq. of Italian Legislative Decree No. 206/2005 (Consumer Code), or a mediation procedure pursuant to Italian Legislative Decree No. 28/2010. A Consumer resident in another Member State of the European Union may contact the competent ADR entities in their own country, as well as the European Consumer Centres Network (https://www.eccnet.eu). Pursuant to Art. 141-sexies of Italian Legislative Decree No. 206/2005, RTLP declares that it has not committed in advance to any specific ADR entity and that it assesses on a case-by-case basis whether to participate in the procedure proposed by the Consumer. The Consumer's right to bring proceedings before the competent court at any time, pursuant to Arts. 19 and 20.2, letter a, remains unaffected.

Art. 21 — Language of the Terms and language versions

21.1. The original version of these Terms and of the Appendices is drafted in Italian.

21.2. These Terms and the Appendices may also be made available in other languages in order to facilitate their understanding by Users. Translated versions are provided for information purposes.

21.3. In the event of any discrepancy, conflict or doubt as to interpretation between the Italian version and any translated version, the Italian version prevails.

21.4. This article is without prejudice to the rights granted to a User acting as a Consumer by the mandatory rules referred to in Art. 19.3, including those requiring contractual information to be drafted or made available in the official language of the Consumer's country of residence.

Appendices

The following documents form an integral part of these Terms pursuant to Art. 2.2:
